1. Agreement to Terms
By accessing or using Noktura ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Noktura is an agricultural image hosting platform that enables users to:
- Upload and organize agricultural imagery
- Add standardized metadata (crop types, growth stages, GPS coordinates)
- Share datasets privately, with groups, or publicly
- Search and discover datasets from other researchers
- Download datasets for research and farming purposes
3. Account Registration
To use certain features, you must create an account by:
- Providing a valid email address
- Authenticating via Google OAuth or email/password
- Agreeing to these Terms and our Privacy Policy
You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access
You must be at least 16 years old to create an account.
4. Acceptable Use
You agree to use Noktura only for lawful purposes related to agricultural research, farming, and related scientific activities.
You MAY:
- Upload agricultural images you have rights to
- Share datasets under appropriate licenses
- Download datasets for permitted uses
- Use for research and commercial agriculture
You may NOT:
- Upload illegal or offensive content
- Upload content you don't have rights to
- Circumvent security measures
- Scrape or bulk download without authorization
- Share account credentials
5. Content Licensing
When you upload content to Noktura, you retain ownership of your content.
For Public Datasets
When making a dataset public, you must select one of these Creative Commons licenses:
- CC BY 4.0 - Attribution required, commercial use allowed
- CC BY-NC 4.0 - Attribution required, non-commercial use only
For Private & Group Datasets
Content in private or group-shared datasets remains accessible only to you or specified groups. No license is granted to the general public.
6. Public Dataset Persistence Policy
Important Notice: When you make a dataset public, other researchers may download and incorporate your data into their work. To respect the research community and maintain data integrity:
- If you delete your account, public datasets will remain available under the license you selected
- Your name will be replaced with "Deleted User" on orphaned datasets
- This ensures research continuity for others who relied on your published data
- If you wish to remove a public dataset, you must delete it before deleting your account
7. Group Dataset Handover Policy
If you delete your account and own datasets that are shared with groups:
- You will be offered the option to transfer ownership to another group member
- If you decline to transfer, the group-shared datasets will be deleted
- Group members will be notified of the ownership transfer or deletion
8. Prohibited Content
The following content is strictly prohibited:
- Content that infringes intellectual property rights
- Content that violates any applicable law or regulation
- Malware, viruses, or malicious code disguised as images
- Content unrelated to agriculture, farming, or agricultural research
- Personally identifiable information of others without consent
- Content that harasses, threatens, or harms others
We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts that repeatedly violate our policies.
9. Storage and Quotas
Free Accounts
5GB storage limit
Paid Accounts
Variable limits per subscription tier
We reserve the right to enforce storage quotas and remove inactive accounts after extended periods (with 30 days notice via email).
10. Payments and Subscriptions
Paid features are billed through Stripe. By subscribing, you agree to:
- Pay all fees when due according to your billing cycle
- Automatic renewal unless cancelled before the renewal date
- No refunds for partial billing periods
You can cancel your subscription at any time through the Settings page.
11. Termination
By You
You may delete your account at any time through the Settings page. See Sections 6 and 7 for how your data is handled upon deletion.
By Us
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent activity
- Abuse the service or other users
- Fail to pay fees when due (for paid accounts)
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
We do not guarantee:
- Uninterrupted service availability
- That the service will meet your specific requirements
- The accuracy of weather or species data from third-party APIs
- That user-uploaded content is accurate, legal, or safe
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of data, profits, goodwill, or business opportunities
- Damages exceeding the amount you paid us in the past 12 months (or $100 if you haven't paid)
14. Indemnification
You agree to indemnify and hold harmless Noktura and its operators from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
15. Governing Law
These Terms are governed by and construed in accordance with applicable law.
For EU users: Nothing in these Terms affects your statutory rights under EU consumer protection law. Any disputes may be submitted to the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
16. Changes to Terms
We may modify these Terms at any time. We will notify you of significant changes via:
- Email to your registered address
- Banner notification in the application
- Requirement to re-accept updated terms
Continued use of the Service after changes constitutes acceptance of the new Terms.
